• INTRODUCTION
  • These terms of use (“Terms”) govern your access and use of the Raghwa App, including all information, tools, and services available, provided that you accept all of the clauses set forth in these terms.
  • Raghwa is an application that works on ANDROID and IOS systems, which provides vehicle wash services by scheduling the bookings according to the subscription package; we kindly ask you to read these terms carefully before accessing the App or subscription to the service to ensure that you understand each provision before using the app as it affects your legal rights.
  • By accessing the Raghwa App, registering an account, and/or continuing to use the services, you confirm that you have read and understood these terms, and agree to be bound by them. If you do not agree to all the clauses of these terms, you may not access the App.
  • These terms are subject to update, change, or modification by us at any time. Please check them regularly to see any updates or changes to them, and any new version of the terms will automatically be effective when they are published on the App, and your continued use of the Raghwa App following any such modification constitutes your agreeing to these terms as so modified.
• ELECTRONIC CONTRACT
  • These terms shall be deemed a valid electronic contract complete with legal conditions and statutory pillars between you as a user, and Raghwa App and its provisions are binding on all users, and no one may relinquish it as long as it produces its legal effects.
  • All binding legal implications of this contract are legally valid from the date of creating an account use of the App and become bound by them as your commitment to the contracts concluded in writing, and it results in the same legal effects that these contracts produce.
  • These terms are drafted in accordance with the laws in force in the KSA, and you are bound by all of their provisions and may not exclude any of their provisions.
• ELIGIBILITY AND REGISTRATION REQUIREMENTS

You are eligible to register an account if you meet the following eligibility criteria:

• You agree to the terms and conditions, and rules for operating the App.
• You have the full legal capacity and unrestricted legal authority to conclude the contracts, and you have the full power and authority to contract, so you won't be in violation of any law or contract.
• You represent yourself, and your account is personal, and not claiming to be registered on behalf of anyone else.
• You have never been prevented or suspended from using the App at any time.
• Your registration and your use of the App are in compliance with all applicable laws and regulations.
• You must cooperate with our requests for any additional information with respect to your eligibility for the usage of our services.

• MEMBERSHIP POLICY
  • You can register an account on the Raghwa App, and you will need to provide us with certain data. Your registration may not be approved if you do not provide us with the following data (name, email, mobile number, password, and approval of terms & conditions).
  • You must maintain the account data, and shall bear the responsibility for any disclosure of this data to others, and in all cases, abide by all the actions made through the account.
  • You must promptly notify us of any illegal use of the account, or in case of finding out any illegal practices or activities through the App.
  • The membership on the Raghwa App is provided with a licensing system for using the App and services, so we have the right to revoke this license and terminate your membership at any time without providing any reasons.
  • We shall have the right immediately, without any legal liability, to limit, suspend, or permanently withdraw your access to our services, or cancel your account for any reason if we prove the following:
    • If your fail to comply with the terms and conditions or rules and guidelines of using the Raghwa App.
    • If you provide data or information, we deem it incorrect, inaccurate or fake, or false claims.
    • If you use the account in a manner not permitted under these terms.
    • If you use an invalid address, email, and phone number.
    • If you use stolen or fake payment cards.
    • If your actions caused us any damages, losses, or liability.
    • If we see any other violations, at our sole discretion, in any other circumstances.
  • In the event that we fail to take any actions against any violations by you or anyone else, this does not mean a waiver by our right to take any legal actions regarding those violations, and we do not warrant taking such action against all possible violations of these terms.
• PACKAGES POLICY
  • Raghwa App provides different packages for washing vehicles, you may choose the suitable package through the App.
  • All package prices are in Saudi Riyals (SR), and are subject to change from time to time.
• BOOKINGS POLICY
  • This policy shall be applicable to the bookings that you submit through Raghwa App.
  • All services data in the Raghwa App, including the prices, other details, are provided and updated directly from the wash service provider, and although we give high care to assure the validity of the information and its conformity with reality, the extent of our responsibility is governed by the scope of our direct services, however, prices and availability are a direct responsibility of the service provider.
  • Wash prices may vary depending on the car wash location, and the wash service provider in your geographic location.
  • After choosing the service provider in your area, you must pay through one of the available methods in the Raghwa App, and the booking will be confirmed and issued immediately after completing the payment process, and we attempt will be made to maintain regular bookings at the same times.
  • You must be sure that all personal belongings and other significant items are removed from your vehicle before implementing the service.
  • Raghwa App shall not be liable for any belongings, items, or money lost from the customer’s vehicle.
  • You must treat the service provider and staff with respect, and we will not tolerate any verbal or physical abuse towards any employee under any circumstances, and will take the relevant actions if any such behaviors are encountered.
  • We retain the right to modify or change a booking in line with weather conditions and /or machinery or equipment failure or other matters beyond our control, and you will be notified of this prior to the wash.
  • We retain the right to refuse any bookings above and beyond the booked service for example providing inaccurate information or using counterfeit cards and rejecting it by the payment service provider.
• PAYMENT POLICY
  • Raghwa App provides payment through Mada – MasterCard – Visa.
  • All transactions made through credit cards are due with immediate effect.
  • We do not store credit card numbers on our systems. Your payment details are protected before being transmitted using the latest electronic protection that follows the highest safety standards.
  • You must be sure that the information about the payment is correct, accurate, and valid before the completion of the payment process, and assume the whole responsibility for any errors in the payment process.
  • You shall not bear any liability if you make an error in the payment process, nor will be liable because of piracy or fraud process on the internet.
  • We reserve the right to amend the payment policy by adding new payment methods in the future, cancel any current method, and you will be informed if this is applied.
• ASSESSMENT POLICY
  • The user has the right to assess the service, and the assessment must be true, objective and legal.
  • The assessments shall not be misleading, offensive, slanderous, or contain offense to others.
  • It is prohibited to use any religious slogans, phrases contemplating to cultures or peoples, or to conflict the laws during the assessment.
  • Raghwa App shall be bound to add and display the assessment on the service page.
  • Raghwa App shall be entitled to delete any assessment that violates the terms or that constitutes an assault on any user or person from a third party.
  • Raghwa App shall be entitled to resort to the judiciary and get all the appropriate compensations in case the assessments result in damages to the App while reserved by the prejudiced person and the society of his right to the criminal punishments.
• WARRANTIES
  • As a user of the Raghwa App services, you warrant, represent, and undertake that:
    • You shall fully comply with all applicable laws and regulations, including, all privacy laws and content regulations.
    • Using the services at your own risk, and you bear full responsibility as a result of such use.
    • Compliance with the restrictions on your use of the App as set out in these terms.
    • Information sent to us does not violate any property rights, encourage terrorism and hatred, or contain political, offensive, or pornographic material or information.
    • Compensate us for any loss or damage caused by non-compliance with these terms and conditions or because you violated these terms, and you must bear the costs and expenses of any direct and indirect claims.
    • Your performance of your obligations under these terms shall not conflict with any laws, rules, regulations, or governmental guidelines to which you are subject.
    • If you create or use an account on behalf of a business entity, you are authorized to act on behalf of such entity and ensure that it complies with these terms.
    • You own or have the authority to grant the rights and licenses granted to us by you under these terms.
    • Any content you submit as part of your use of the services and any products that you list do not violate the rights of any third party.
  • The Raghwa App is provided on an “as is” and “as available” basis, and we make no warranties or representations of any kind whether express or implied with respect to the Application or convenient for a particular purpose, compatibility, security, accuracy, reliability or completeness of any content, information, software, text, images, links through the use of it.
• LEGAL DISCLAIMER
  • We will not be liable for any damages or losses either directly or indirectly resulting from:
    • Information, contents, or recommendations relating to the App or services.
    • Any fault in the payment, or use of cards that you are not authorized to use it.
    • Any loss of personal belongings, money, and other significant items in the vehicle before we offer our service.
    • Any matters beyond our control, and we have nothing to do with it, including the failure of electronic devices or communications, operating errors, any possible interruption or emergency due to, but not limited to, periodic maintenance works, technical problems or other similar causes.
    • Any failure to maintain the security, confidentiality, and privacy of your account data.
    • Any external links can be accessed through the Raghwa App or any content provided on such links.
    • Any suspension of the account or other action was taken by us with respect to your failure to comply with these terms.
  • We shall not be liable for any failure or delay in performance due to circumstances beyond will, force majeure, or emergency circumstances resulting in the suspension or disruption of the App
  • You declare that the Raghwa App is an internet-based service, and in spite of exerting our best to keep information safe, we can’t guarantee that information received or transmitted by the user while using the services will be safe at all times.
• LICENSES & RESTRICTIONS
  • LICENSES

Raghwa App grants you, solely for your personal use or for your internal business operations, as applicable, a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:

• Download, install and use the application for your personal, non-commercial use on your mobile device owned or controlled by you.
• Access and use the App, including access to the content, information, or related materials that may be made available through the App, and strictly in accordance with these terms.

• RESTRICTIONS

The rights granted to you in these terms are subject to some restrictions, you may not:

• Make modifications to the App and interfere with or circumvent any feature of it.
• License, sell, rent, transfer, assign, distribute, host, or otherwise commercially exploit the App.
• Modify, translate, adapt, merge, make derivative works of, or disassemble any part of the App.
• Access the App in order to build similar or competitive services.
• Remove, ravage or change any trademarks, copyright, or other property marks contained on the App.

• The licenses granted to you by us will terminate if you do not comply with the Raghwa App terms and conditions. If you are prohibited from using the App under the applicable law, you may not use it.
• We may, without notice or liability, impose limits on certain features and services or restrict your access to all or portions of the App at any time.

• PROHIBITED CONDUCT
  • Your use of the Raghwa App shall be subject to the legal requirements governing it. So you agree that you will not:
    • Use the App outside the scope of the purposes explicitly permitted by the terms and conditions, or breach any applicable local law, regulation, or rules of practice.
    • Use the App in any way that causes damage to our business, reputation, or our trademarks.
    • Impersonate any user or entity, including any employee or representative of the Raghwa App.
    • Transfer your account to another party without our prior written consent.
    • Post spam, unsolicited or bulk electronic communications, or similar.
    • Post any false, inaccurate, misleading, deceptive, defamatory, or similar content.
    • Post or distribute viruses or any other technologies that may harm our services or the interests of other users.
    • Infringe the copyright, trademark, patent, publicity, database, and/or other intellectual property rights that belong to or are licensed to us, or any third party.
    • Interfere with security-related features or the operation of the App by:
      • Disabling or circumventing features that prevent or limit the use or copying of any content.
      • Reverse engineering or otherwise attempting to discover the source code of any portion of the App.
      • Tampering with data and information, and attempting to modify or destroy any security or documentary procedures.
      • Uploading or otherwise disseminating any virus, adware, spyware, worm, or other malicious code designed to damage, interfere with or identify the normal operation of the App or any part thereof.
      • Collecting personal information about another user or third party without consent.
      • Interfering with or disrupting any network, equipment, or server connected to or used to provide the App.
      • Attempting to gain unauthorized access to the App or any networks, servers, or computer systems connected thereto.
    • If we find that you have made any of the previous uses, we are entitled to:
      • Deleting any materials or contents that you have posted without notifying you.
      • Stopping, suspending, restricting your access, or preventing you from using the App or terminating your account immediately.
      • Reporting your activities to the relevant authorities, and taking legal action against you.
    • INTELLECTUAL PROPERTY RIGHTS
      • All intellectual property rights including all copyrights, commercial appearance, designs, logos, icons, and other intellectual property, materials, and other rights, including software rights and other symbols it contains, including content, text, fonts, images, programs, audio files, music, video, digital materials, documents, data and forms, and arrangement of the contents, are the property of Raghwa App or its licensors and It is protected by intellectual property and trademark laws.
      • The images, logos, words, header of pages, button icons, and service names related to and on the App are the property of Raghwa App or its licensors, and you may not use any of these trademarks or any variations thereof, for promotional purposes, in any way that deliberately or inadvertently.
      • You are prohibited to publish, distribute, otherwise reproduce or copy any of the content supplied to you or which is provided on the Raghwa App, or use any part of the App content for commercial purposes without obtaining a license from us to do so.
      • Any unauthorized use, copying, imitation, or distortion of the Raghwa trademark is a violation of our rights under trademark laws. We reserve all our rights to require appropriate damages.
      • All rights not expressly granted to you in these terms are reserved and retained by us or our licensors.
    • INDEMNIFY
      • You agree to indemnify Raghwa App, and its affiliates from and against any losses, damages, fines, costs, or expenses (including legal fees and attorney’s fees) (“Claims”) arising out of or relating to:
        • Any claims or demands made by any third party due to or arising out of your use of the App.
        • Your violation or failure to comply with Raghwa App terms and conditions or any additional rules or instructions posted on the App.
        • Your violation of any applicable laws, including, without limitation, data protection or anti-spam laws.
        • Your violation of any third-party rights, including confidentiality or privacy right.
      • You must acknowledge that you agree to cooperate fully in the manner we define to defend or resolve any claims.
    • LINKS TO THIRD PARTIES
      • Raghwa App may contain links to other websites operated by third parties, we do not endorse these links and are not responsible for any content, ads, or other materials available on these websites, and if you decide to access any of other parties' websites, you do so at your own risk.
      • You acknowledge that you are solely responsible for all risks that may arise from your use of any such websites, resources, content, products, or services that exist or are available on them.
      • You agree not to involve us in any dispute you may have with any third-party website or service, and your use of such third-party websites is at your own responsibility.
    • E-COMMUNICATION
      • When you complete your membership, you agree that we can communicate with you via e-mail and you approve of all agreements, notices, or statements or any other communications we can offer you electronically to meet with the legal requirements as if such communications were written.
      • If you want to stop the promotional messages you receive, you can choose to do so by clicking below the message and unsubscribing.
    • TERM AND TERMINATION
      • These terms commence from the date you register an account or use the App and acknowledge your acceptance of it and will continue in effect until terminated by you or us, and we may terminate this agreement at any time without notice if you violate any of Raghwa App terms and conditions.
      • The provisions of these terms shall be terminated on their own in the event that your use of the Raghwa App causes any legal problems for us.
    • MODIFICATION
      • We may the right to modify and update these terms from time to time at our sole discretion, and all modifications will be effective immediately when posted and apply to all use of the App thereafter, and your continuity of using the Raghwa App after updating these terms shall be deemed a legal acceptance of the new terms and conditions, and you agree that all previous versions of these policies are superseded by the modified version.
      • We may modify our services, add new services and delete or replace current services at any time without requiring prior or subsequent approval from the user.
      • We will have no liability for any change to the service or any suspension or termination of your access to or use of the App.
    • GOVERNING LAW
      • These terms and conditions shall be governed by and construed in accordance with the laws of the KSA.
      • The Saudi courts shall have jurisdiction over any dispute that might arise from the interpretation or performance of these terms.
      • If any provision of these terms is determined by any court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be severed from these terms and the remaining provisions will continue in full force and effect.
    • OTHER PROVISIONS
      • DIGITAL SIGNATURE: your using the Raghwa App services, registering an account, or via clicking for accepting the terms and conditions upon claiming so shall be considered an electronic signature on these terms and express consent of all the terms contained therein, shall be legally enforceable for you from the date of registering the account, using the service or from the date of clicking for accepting the terms and conditions.
      • RELATIONSHIP OF THE PARTIES: None of the provisions contained in these terms will be construed to constitute a relationship of partnership or joint venture or agency between Raghwa App and you as a user or any third party, and you will have no authority to bind us in any manner whatsoever.
      • NO WAIVER: it is prohibited to assign your obligations and rights under these terms or authorize another party to manage your account except after getting written consent from us and failure or delay by us to enforce any of these terms will not constitute a waiver of our rights against you and does not affect our right to require future performance thereof.
      • TRANSFER OF RIGHTS AND OBLIGATIONS: We shall be entitled to transfer all of our rights or obligations mentioned in these terms to third parties without any objection by the user, provided that such a third party agrees to be bound to these terms.
      • THIRD PARTY RIGHTS: a person who is not a party to these terms has no right to enforce any of its provisions.
      • LANGUAGE: these terms are drafted in both Arabic and English; the Arabic text shall be deemed the certified text in relation to the interpretation of these terms and applicable before all the official and unofficial bodies if the English language conflicts with it.
      • CONFLICT: in the event of any conflict between these terms and any prior versions thereof, the provisions of these terms shall prevail unless it is expressly stated otherwise.
      • ENTIRE AGREEMENT: these terms and privacy policy constitute the entire agreement between you and Raghwa App, regarding your use of the App and services, and supersede any versions of these terms.
      • SURVIVAL: all provisions of these terms, either expressly or by their nature, will survive suspension or termination of your membership of the Raghwa
      • CONSENT: you acknowledge that you have read these terms and agree to be bound by their provisions.
